Nursing student suing university for discrimination after failing course twice

A disabled nursing student (i.e. prone to anxiety, depression and difficulties with concentration) is suing for discrimination http://www.timesleader.com/news/local-news-news/153452858/Woman-suing-Misericordia-over-failed-course According to the suit, Burbella was seen for much of her time at Misericordia at a university counseling center for her anxiety, depression and difficulties with concentration... ..after receiving two failing grades in the class was allowed extra time to complete tests as well as access to a “distraction-free environment” when taking them at the recommendation of a school psychologist. The complaint says that prior to the course’s final examination, Burbella’s professor, Christina Tomkins, offered an additional accommodation in allowing her to ask questions of the professor via cell phone during the test. … According to the complaint, Tomkins did not answer her cell phone during the examination, rendering Burbella unable to discuss the exam with her. The suit says a university counselor witnessed Burbella “breaking down and crying” when several calls to her professor went unanswered. Burbella again did not score well enough in the course and was not allowed to graduate with a nursing degree. Is this going to open the floodgates for lawsuits by students unhappy with their grades?
